A friend of mine is having issues with a tenant/ex-tenant right now. The people moved from Michigan to Florida...they left some of their stuff at the house and are not trying to fine movers to move the rest of the stuff...so there comes my question...are moving companies allowed to have anyone go into the house even if the tenant or ex-tenant is not there?

Hi DeAnna, and thank you for your question!

Moving companies

Normally, a moving company is hired by a tenant and then carries out the job while the tenant still has a lease on the apartment/house. However, if the tenant no longer resides at the space and leaves some of his/her belongings behind, it is the right of the landlord to deal with any items in the house. I assuming that the reason this is an issue is because your friend doesn't want to have to pay for a company to remove the items from the space.

While the tenant/former tenant should be responsible for removing his/her own items from the space, they do not have a right to items they've left behind. If your friend cannot get in touch with the former tenant--and if your friend does not intend to keep any of the items left in the house--we would recommend hiring an inexpensive removal company to dispose of the remaining belongings of the tenant.

We hope this helps. Thanks for your question!
